1. General Information

These Terms and Conditions apply to all orders placed through our online shop www.publikat-press.com (powered by Shopify) by consumers and businesses.

A consumer is any natural person who enters a legal transaction for purposes that are predominantly outside their trade, business, or profession. A business is a natural or legal person or a partnership with legal capacity who, when entering a legal transaction, acts in the exercise of their trade or profession.

The presentation of products in the online shop constitutes no binding offer, but a non-binding invitation to place an order. You can add products to your shopping cart and review your input before submitting a binding order. The contract is concluded when you submit your binding offer to purchase the items in your cart by clicking the order button. The confirmation of receipt of your order will be sent by email immediately after you submit your order.

 

3. Language of the Contract, Storage of Contract Text

The language available for concluding the contract is English.

We do not store the contract text. You can print or save the order details immediately after placing the order.

 

4. Prices and Shipping Costs

All prices include the statutory value-added tax (if applicable) and are exclusive of shipping costs. The exact shipping costs will be indicated in the checkout process.

6. Payment

By placing an order through our website, you agree to provide current, complete, and accurate purchase and account information.

We accept the following payment methods:

  • PayPal
  • If available: Shopify Payments (including major credit cards such as Visa, MasterCard, American Express, etc.)

All transactions are subject to validation and authorization by the respective payment provider. We reserve the right to refuse or cancel any order if fraud or an unauthorized or illegal transaction is suspected.

 

7. Retention of Title

The goods remain our property until full payment has been made.

 

8. Right of Withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the day you or a third party named by you (who is not the carrier) received the goods.

To exercise your right of withdrawal, you must inform us at hello@publikat-press.com of your decision to withdraw from this contract by means of a clear statement.

If you withdraw from this contract, we will refund all payments received from you, including delivery costs (except for additional costs resulting from your choice of a delivery method other than the standard one offered by us), without undue delay and no later than 14 days from the day we receive notice of your withdrawal.

We may withhold the refund until we have received the goods back or you have provided proof that you have returned the goods, whichever is earlier.

You must return the goods without undue delay and in any event no later than 14 days from the day you notify us of your withdrawal. You bear the direct cost of returning the goods.

 

9. Warranty and Liability

The statutory warranty rights apply.

We are liable for damages caused by us, our legal representatives, or agents, without limitation, in the event of injury to life, body, or health, in the event of willful or grossly negligent breach of duty, or if the application of the Product Liability Act applies.

In the case of slight negligence, we are only liable for breaches of essential contractual obligations (cardinal obligations), and liability is limited to the foreseeable damage at the time of the conclusion of the contract.

 

10. Final Provisions

Should any provision of these Terms and Conditions be invalid, the remainder of the contract shall remain valid. The invalid provision shall be replaced by the relevant statutory provisions.
